Terms and conditions - use of the cookwise.co.uk website.

Access to, and use of this site (cookwise.co.uk) is provided by Cookwise, subject to the following terms.

1. By using cookwise.co.uk you agree to be legally bound by these terms which shall take effect immediately on your first use of cookwise.co.uk. If you do not agree to be legally bound by all the following terms please do not access and/or use cookwise.co.uk

2. Cookwise terms and conditions may be changed at any time. Please review the terms regularly to ensure you are aware of any changes made by Cookwise.

3. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use cookwise.co.uk content in any way except for your own personal, non-commercial use.

4. You also agree not to adapt, alter or create a derivative work from any cookwise.co.uk content except to your own personal non-commercial use. Any other use of cookwise.co.uk content requires the prior written permission of Cookwise.

5. You agree to use cookwise.co.uk only for lawful purposes and in a way that does not infringe the rights of or restrict or inhibit anyone else's use and enjoyment of cookwise.co.uk. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within cookwise.co.uk.

6. cookwise.co.uk content, including the information, names, images, pictures, logos and icons regarding or relating to Cookwise, its products and services, is provided without any warranty, except that required by law.

7. Cookwise will not be liable for any losses or damage caused by using the cookwise.co.uk website

8. Cookwise does not warrant that functions contained in cookwise.co.uk content will be uninterrupted or error-free, that defects will be corrected, or that cookwise.co.uk, or the server that makes it available is free of viruses. Reasonable steps will be taken by Cookwise, and anti virus software installed to reduce risk.

Intellectual property

1. All names images and logos identified with cookwise.co.uk, are the property of Cookwise.

Contributions to cookwise.co.uk

1. In submitting contributions, sent via the website e-mail link, you will agree to the use of the content of those contributions by Cookwise in any way they wish in accordance with privacy restrictions set out in the Cookwise privacy policy.

2. Any contribution should be a original, and you agree that you have the right to make it available to Cookwise for any purpose.

3. Any contribution should not be defamatory.

4. Any contribution does not infringe any law.

5. You would indemnify Cookwise against all legal fees, damages and other expenses that may be incurred by Cookwise as a result of your breach of the above conditions.

Any terms and conditions determined to be illegal, invalid or otherwise unenforceable, shall be removed but the remaining terms remain in full effect, and continue to be binding and enforceable

This agreement is subject to English Law.

Conditions of use – goods or services supplied

1. This agreement shall apply to all contracts for the sale of goods or services by us to you to the exclusion of all other terms and conditions including any terms or conditions which you may purport to apply and any purchase order, confirmation of order or similar document.

2. All orders for goods or services shall be deemed to be an offer by you to purchase goods or services.

3. Acceptance of delivery of the goods or services shall be deemed conclusive evidence of your acceptance of this agreement.

4. Any variation to this agreement (including any special terms and conditions agreed between the parties) shall be inapplicable, unless agreed in writing.

5. Nothing in these conditions shall affect the statutory rights of any consumer.

Prices

1. The price shall be the price set out on the order confirmation or attached order. All prices are quoted in UK pounds.

2. Cookwise shall not be bound to deliver the goods or services until you have paid for them.

Warranties and liability

1. You agree to use the goods or services at all times, in accordance with the instructions, notices or information included in the goods or services, and on the packaging of the goods or services.

2. Cookwise is not responsible for the safety of anyone using goods or services supplied by them. All children should be suitably supervised and are not the responsibility of Cookwise.

3. We warrant that the goods or services will, at the time of delivery, correspond closely to the description given by us. Similar alternative items may be included if supplies of those described are unavailable.

Delivery of the goods or services

1. The goods or services shall be delivered to you on the transfer of the goods or services to our nominated carrier. .

2. Title and risk shall pass to you on delivery of the goods or services.

Cancellation.

1. You have the right to cancel any contract on notice in writing received by us within seven days of the date of order of the goods or services.

2. Cancellation of any contract, howsoever or whenever occasioned shall be subject to any rights and remedies the parties may have under this agreement or in law.

3. The cost of return of any goods or services on cancellation will be your responsibility.

Your remedies

1. Where goods or services are rejected by cancelling this agreement, you shall have no further rights whatever in respect of the supply to you of such goods or services.

2. We shall not be liable to you for late delivery of the goods or services.

General,

1. We shall not be under any liability for any loss or any failure to perform any obligation here that are due to causes beyond our control, including, without limitation, industrial disputes of whatever nature, acts of God or hostilities.

2. If any provision of this agreement is held by any competent authority to be invalid or unenforceable in whole or in part, validity of the other provisions of this agreement and the remainder of the provision in question shall not be affected thereby.

3. No forbearance or indulgence on the part of us in enforcing this agreement shall prejudice strict rights, nor be construed as a waiver hereof.

4. Both parties undertake to each other to comply with the Data Protection Act 1998 in so far as it relates to this agreement, and you hereby agree to the processing of your personal information by us for the purposes of complying with our obligations under this agreement.

5. A person who is not a party to this agreement, has no right under the Contract (Rights of Third Parties) Act 1999 to enforce any provision of this agreement, but this does not affect any right or remedy of a third party, which exists or is available apart from the Act.

6. Any notice or communication between the parties shall be in writing, but, unless otherwise stated, may be made by e-mail, fax or recorded delivery post to the address as provided on the order. Notices sent by e-mail should be deemed served on electronic confirmation of delivery, by fax on receipt of an error-free transmission report, or by recorded delivery, two days following the date of posting

This agreement is subject to English law.

Terms and conditions – Cookwise Holiday Workshops.

1. Availability is limited, so all bookings should be made in advance with full payment.

2. Telephone/e-mail reservations will be held for 48hrs for payment to be made, after which the place will be reallocated.

3. Refunds cannot be made unless at least 24 hrs notice is given. As ingredients will already have been ordered a 30% charge will be made for all cancellations within 7 days of the course.

4. Cookwise reserve the right to change arrangements to the daily programme, but start and finish times will remain the same.

5. Any belongings brought to the course are the responsibility of the child.

6. All children should wear sensible footwear suitable for working in a kitchen (not flip flops or high heels)

7. You will be given a brief Health and safety talk prior to the Class starting.

8. All of the classes are hands on and involve heat and the use of equipment, all participants are expected to listen to the advice on prevention of accidents.

9. On booking a course, you agree that we shall be under no liability whatsoever, for loss, injury or damage to you or your property whether in respect of any neglect, act or omission by us or otherwise. When a payment is received we will confirm the booking.

10. All children are expected to behave. Children not behaving will be asked to sit quietly until a parent arrives to collect them. All children must have confirmation forms with details of the parent/carer and contact telephone numbers available. With out this they will not be allowed to attend the course.

9. Parents must indicate on the confirmation form who will collect the child, or that the child will go home unaccompanied.

10. We will endeavour to accommodate all children, but parents of children with special needs should contact Cookwise before booking to discuss any special arrangements that may need to be put in place.

11. All children will be covered by our Public Liability Insurance.

12. In the event of an accident, first aid will be administered by Cookwise staff. If necessary the emergency services will be called, unless we are told otherwise. Please advise us if you wish other arrangements to apply to your child.

13. On hot days we may eat lunch outside. Please bring hats and sun cream.

14. We may take photographs during the course for use in future promotional material. If you do not wish your child to be photographed, please advise us.

15. All food will be stored and cooked according to Health and Safety regulations. Once the food leaves the cooking room, it is the responsibility of the child and parent/guardian to transport the food safely, and reheat thoroughly if necessary.
